Have your say: Equality and Human Rights Commission (EHRC) Code of Practice
The Equality and Human Rights Commission (EHRC) create guides, called Codes of Practice, for organisations and services to use, to help them follow UK equality law.
In May 2025, the Code of Practice related to the Equality Act 2010 was updated to include new legal changes that are a result of the UK Supreme Court’s decision that the protected characteristic of ‘sex’ means ‘biological’ (or‘ sex recorded at birth’), rather than ‘legal’ (or acquired) sex. This change in law will change how single sex spaces and services, sports teams, toilets, changing rooms and other facilities are run, which may affect trans and non-binary people, LGBQ+ people, gender non-conforming people, cisgender women, and other groups.
The EHRC is asking you to give your opinion on the changes they have made to the Code of Practice, and how you will be affected by them.
LGBT Foundation have produced guidance to support responses to the Consultation. Read it here.
This is an opportunity to make sure LGBT voices are heard. Join us in calling for the EHRC to:
- Make sure any changes uphold the rights of trans and non-binary people
- Prevent 'gender policing' according to a narrow view of what it means to be a woman
- Understand that excluding trans women from women's spaces does not make cis women safer
- Ensure that trans and non-binary people can access healthcare services and safely participate in everyday life
